Terms and Conditions for the use of the RODBUK Cracow Open Research Data Repository


The following constitute terms and conditions shall be hereinafter referred to as the "Terms" define the rules for the use of the RODBUK Cracow Open Research Data Repository.

§ 1
General terms

  1. RODBUK Cracow Open Research Data Repository is co-developed by academic institutions on the basis of separate agreements.
  2. The Repository allows for the admission of new members, e.g., specifically other scientific institutions that are part of the higher education and research system or support its operations (Act of July 20, 2018, Law on Higher Education and Science, Article 7, Section 1 and 2).
  3. Detailed criteria for admitting new members to the Repository are defined by the RODBUK Data Management Group regulations, published on the RODBUK repository website.
  4. The purpose of the Repository is to make research data produced, collected or described in the course of scientific research available over the Internet.

§ 2
Rules for the use of the Repository

  1. The purpose of the Repository is:
    1. making metadata and research data from all fields of science publicly available,
    2. depositing, storing, viewing and retrieving research data.
  2. Viewing and downloading of research data is possible provided that the relevant licences assigned to them are maintained.
  3. Any individual wishing to deposit research data in the Repository must have an individual depositor account.
  4. A person who is entitled to set up a depositor account in the Repository is an academic staff member, doctoral student or student affiliated by the co-administrator.
  5. The depositor registers in the system by authorisation through the Central Authentication System (CAS).
  6. Any actions carried out in the Repository with a given login and password shall be considered as actions carried out by an authorised depositor.
  7. The registration data may only be edited by logging into the depositor's own depositor account and making the appropriate changes.
  8. The depositor may only have one depositor account in the Repository.
  9. Each deposited dataset shall be assigned a DOI Identifier. One dataset may only be assigned one individual DOI Identifier. In order to assign an individual DOI, the services of the DOI RA are used, which involves the transfer of metadata to the DOI RA.
  10. In the case of interuniversity projects, the rules of procedure shall be those approved at the academic institution of the project leaderu.

§ 3
Storage and sharing of research data

  1. The depositor may store and make publicly available research data in the Repository.
  2. The depositor shall be fully responsible for the research data posted and for any possible infringement of the copyrights and property rights of third parties and related rights. In the event that the co-administrator incurs any costs as a result of the depositor's actions, the depositor agrees to pay the said costs in full (including any damages or compensation, costs of legal proceedings and enforcement costs).
  3. The use of the Repository or the deposit of any data in the Repository by a depositor shall not:
    1. infringe any copyright or other intellectual property rights, including but not limited to patents, trademarks, trade secrets, copyrights, rights of publicity or other rights of any third party;
    2. infringe any legal provisions;
    3. be threatening, abusive, harassing, defamatory, deceptive, fraudulent, invasive of another's privacy or otherwise offensive or unlawful;
    4. constitute spam;
    5. introduce into the Repository or otherwise use computer viruses or any other computer code, files or programs that are designed or intended to interfere with, damage, restrict or disrupt the correct functioning of any software, hardware or telecommunications equipment or that are designed or intended to damage or gain unauthorised access to any system, data files or other information of the repository administrator or any third party;
    6. impose an unreasonable or disproportionately large load on the IT infrastructure of the repository administrator;
    7. interfere or attempt to interfere with the proper functioning of the Repository or any of its activities;
    8. lead to the circumvention of any measures that the repository administrator may use to prevent or restrict access to the Repository or to other accounts, computer systems or networks connected to the Repository;
    9. occur without the prior obtaining of the relevant consents of third parties to the inclusion of such data with the content and in the format in which it was entered, if such consents are required by law, contract or on any other legally binding basis;
    10. include data constituting classified information or data protected as a statutory secret – insofar as the use of such data is restricted by law;
    11. include personal data, data covered by the obligation of business secrecy or data invading the privacy of the individual – insofar as the use of such data is restricted by law.
  4. The metadata of the deposited dataset is verified by the data steward for completeness and correctness and then published in the Repository. 
  5. Depositor acknowledges that the data deposited by them may be reviewed by the data steward and the repository administrator as part of periodic monitoring to ensure compliance with the accuracy of submitted declarations regarding personal data and intellectual property rights. 
  6. Research data files found to contain personal data or infringe third-party copyright are no longer publicly available (subject to deaccessioning process).
  7. In case of multi-author or inter-university projects, the person responsible for depositing research data in the Repository is the project leader or a person designated by him/her. The project leader is required to obtain written consent from all co-authors for depositing the research data in the Repository. The person responsible for depositing the data must promptly provide these consents or their copies upon request from the data steward.
  8. Research data posted in the Repository that violate the provisions of the regulations will be removed by the repository administrator without the author's consent.
  9. Depositors upload research data to the Repository free of charge under open licenses such as Creative Commons or other licenses applicable to database or open-source software sharing. Granting a license is part of the deposition process, and the depositor can choose the license type.
  10. Metadata collected in the Repository are available without restrictions, in accordance with applicable law.
  11. Research data are stored in the Repository for the duration of the main agreement.
  12. Materials deposited in the Repository cannot be withdrawn by the depositor.
  13. The integral documents to the Regulations that are binding on the Depositor are:
    1. RODBUK Data Collection Policy;
    2. Privacy Policy;
    3. RODBUK Data Preservation Policy.

§ 4
Final provisions

  1. Any information, suggestions or problems with the functioning of the service should be reported using the contact form available in the support section of the Repository, including the identifying details of the reporter.
  2. The repository administrator reserves the right to make changes to the functionality of the Repository in order to improve its quality without prior notification to the depositor.
  3. The repository administrator will make every effort to ensure that the use of the Repository is possible without significant interruptions or other disruptions.
